SHIELDS: Fighting the Battles After Dobbs

On December 1st, the Supreme Court heard oral arguments in Dobbs v. Jackson Women’s Health Organization, a case which has become conservatives’ best chance to overturn Roe and Casey. As Vice President Pence said, Roe and Casey belong in the ash heap of history. The American republic’s grave sin of abortion has allowed the murder of over 62 million babies and violates our Creed and Constitution. 

If Roe and Casey are upheld or replaced with another repugnant standard permitting abortion, Lone Conservative’s own Jonathan Voos has an excellent article explaining that pro-life activists and the conservative legal movement ought not abandon originalism. While necessary to plan for the worst, it is equally necessary to plan for the best. Even if the cases are overturned, we cannot think the war is won and go home. Dobbs is merely a battle in the war, and if we win, a wide array of new battles shall begin. 

If winning this battle is to be the first great advancement in the campaign for life rather than a significant, but momentary, setback for the pro-abortion agenda, then we must plan ahead and prepare for victory in the future. 

The easiest battle will be banning abortion in those states that already have pro-life legislatures. Perhaps the only concern here is that pro-lifers will come into conflict concerning those issues important, yet not fundamental, to the subject of abortion such as exceptions in cases of rape and incest. While these conflicts must one day be addressed, we must compromise on those issues to whatever extent circumstance necessitates. It is these compromises that will allow us to advance the right to life to the greatest extent possible.

Unfortunately, even if Roe and Casey are overturned, many states will continue to allow abortion. We must replace that culture of death with a culture of life. Educate Americans of the scientific truth that the unborn baby is a human being. Give love and charity to those contemplating abortion. Build safety nets for expecting mothers through community and church, and, to a certain extent, local and state governments. Explain how degrading to women it is to suppose abortion is a necessary step towards equality with men. Show the truth that mothers will find far more fulfillment in a loving relationship with their children than in whatever ends they hope to achieve by obtaining an abortion. Choosing an abortion is already a difficult decision for many mothers, make choosing life as easy as possible.

As goes the culture so goes the political, and we must have these cultural advances for life followed by respective political victories. As pro-abortion states become more open to life, impose as many restrictions on abortion as are feasible, and proscribe it entirely when able. Ultimately we must work towards what is the only possible true victory in this war: an amendment to the federal Constitution forever ending the grave sin of abortion. 

Finally, overruling Roe and Casey will open up a new front to the war which, until this point, has merely consisted of a few scattered firefights—the independence of the judiciary and the packing of the Supreme Court. The Left has no love for our institutions, they see them solely as means or barriers to their ends. Dobbs will make the federal judiciary a great hindrance to them, and they will pronounce it illegitimate until it again serves their prerogatives. 

Through packing the court and other means, they will attempt to deprive the judiciary of its independence, disregarding the separation of powers and perverting justice. Though this judicial battle will be hard fought, the American people fortunately oppose court packing. Having already the will of the people with us, motivate them to act on that will. Defend the independence of the judiciary and ratify an amendment setting the amount of justices at nine. 

God willing, we will soon be rid of the worst decision in the history of the Supreme Court. As glorious as that victory will be, it is not the end, but rather the beginning of our fight for life. Let us plan ahead and lay the foundation for victories in the battles to come, and life will prevail.
