DEVLIN: Democrats Don’t Care about Fairness or the Rule of Law for Kavanaugh

The Democratic opposition to Judge Brett Kavanaugh couldn’t get any more intense as additional sexual misconduct allegations against the Supreme Court nominee have emerged leading up to Kavanaugh’s and Christine Blasey Ford’s testimonies Thursday.

Make no mistake, these confirmation hearings—and the Senate vote that follows—will determine much more than whether or not Kavanaugh winds up on the highest court in the land. For all intents and purposes, this circus has turned into a criminal case in the court of public opinion. Either the Senate confirms Kavanaugh and he ends his career of public service on the Supreme Court, or his failed nomination effectively ends his professional and personal life, with sexual harassment and assault his new legacy.

Yet even regardless of whether or not Republican Senators vote Kavanaugh through, I wouldn’t put it past the Democrats to try and impeach Kavanaugh if they win back the House and the Senate come November.

If these allegations were found to be true, and more evidence was to come out proving Ford and Ramirez’s allegations against Kavanaugh hold weight, then, of course, someone with that level of blatant disregard for women should not have a seat on the Supreme Court, let alone any position requiring an ounce of human decency. Despite what the left-leaning media and Democrats would have you believe, Republicans know this.

But what constitutional conservatives also know is that procedure matters, and they’re not willing to bend the knee to the Democrats’ insanity as they try and kill the president’s nominee via character assassination. They’re also not going to tolerate unreasonable, inoperable requests from the accuser’s lawyers (both of which are long-time Democratic operatives) because they’re antithetical to the procedures deemed necessary to ensure a just verdict for centuries.

Nevertheless, Democratic Senators like Kirsten Gillibrand will call the hearing a sham.

But, the Democrats are the ones trying to turn these hearings into a sham. They want exactly what Debra Katz, an attorney for Ford, initially demanded from the Senate Judiciary Committee in order for her client to come and testify. These demands stack the odds against the judge, and the Democrats are licking their chops for Thursday’s hearings so they can cut into Kavanaugh.

Here is the list of “deal-breaking” demands initially forwarded by Katz and Ford, according to NBC News:

  1. “Wants to testify second and Kavanaugh to appear first;
  2. Doesn’t want Kavanaugh in the room at the same time with her;
  3. Prefers not to be questioned by outside counsel, but rather by the senators on the committee;
  4. Would like the committee to subpoena Mark Judge, the other student Ford alleges to be in the room at the time of the assault, to testify;
  5. Says each senator should have equal time questioning (already committee practice);
  6. No time limit on her opening statement; and
  7. Will appear at a public hearing but she would like to limit the number of cameras to pool coverage.”

Could you imagine any legal procedure where the accused does not have the right to face their accuser, have their attorney, or any attorney for that matter, ask questions of the accuser levying the accusations? What’s more, Kavanaugh would have to testify first, effectively placing the burden of proof on Kavanaugh to rebut more detailed claims that haven’t been fully raised yet, which is exactly why the prosecution goes first in all legal matters. I acknowledge this isn’t a criminal case presented in court. However, if these hearings are going to function like a criminal case in the court of public opinion, the Senate Judiciary Committee should operate with the same level of prudence as our legal system because it is the most effective and responsible way to achieve justice. Reprehensibly, Democrats would rather pour gasoline on our founding documents and light them on fire.  

Democrats on the Senate Judiciary Committee, like former Attorney General of California Kamala Harris, know the proper procedures that help guarantee justice in this country, and so do the accuser’s attorneys. Yet Democrats are now fundraising off of Ford’s accusations and their attempts to ruin Kavanaugh’s career. Senator Mazie Hirono (D-HI) sent out an email trying to solicit donations to her campaign because Kavanaugh “knows he is guilty.” Elizabeth Warren (D-MA) pulled a similar stunt a few days prior. All of this reeks of political hackery.

It also makes it evident that this is just the latest smear attempt by Democrats on a conservative or constitutional originalist rising to a high position in government. Senate Majority Leader Mitch McConnell, and many of his Senate colleagues, remember when Democrats pulled similar stunts on Robert Bork, Clarence Thomas, and Mitt Romney. They also remember when Democrats completely ignored Bill Clinton’s, Keith Ellison’s, and Cory Booker’s alleged misconduct (in Booker’s case, the allegation came from Booker himself as he recounted groping the breast of an unconsenting women in his memoirs).

Democrats ignoring credible impropriety among their own ranks when convenient doesn’t give Republicans the green light to do the same. The evidence very well could change on Thursday, and given more evidence, myself and many other Republicans, are willing to change our opinion on the matter. However, the hysteria riled up by Democrats in an attempt to assassinate Judge Kavanaugh’s character execution-style with hardly a shred of evidence is disgustingly immoral, which is why Republicans remain willing to go out on a limb for Kavanaugh and are protecting his character.

Democrat’s politicization and mishandling of these allegations is why Republicans remain eager to confirm Judge Kavanaugh to the Supreme Court in the very near future.
